Prediction-market operators now face a tighter filing standard for event contracts after the U.S. Commodity Futures Trading Commission warned against broad template certifications on July 26.

The filing issue sits inside a larger jurisdiction fight.

Kalshi, Coinbase, Polymarket, and Crypto.com are among the companies operating in a market where the CFTC is asserting lead oversight, while several states continue to pursue event-contract platforms as illegal sports-gambling businesses.

CFTC Targets Broad Event-Contract Templates

The advisory states that "broad, template-style certifications should not be submitted," marking the second warning in recent months from the derivatives regulator about overly general submissions.

Designated contract markets can still certify closely related event contracts as a class, but the regulator is requesting sufficient contract-level material to review the terms, underlying commodity, settlement method, data sources, and core-principles compliance for each permutation.

This distinction alters the compliance work for platforms that wish to list many similar outcomes simultaneously.

A sports, politics, or other event market may share a common structure, yet the CFTC requires the filing to detail how each proposed contract settles and why each version complies with derivatives-market rules.

State Court Fight Still Shapes The Market

The regulatory boundary remains unsettled as the CFTC's asserted role as the primary prediction-market supervisor is still being tested in court.

The agency, led by Chairman Mike Selig, has fought in state and federal cases to maintain event-contract oversight under its authority.

State actions create a second pressure point for platforms.

If courts allow state gambling enforcement, prediction-market operators may need federal derivatives compliance and separate state-law risk controls before scaling sports or political contracts nationally.

The market’s expansion is especially visible in sports and political outcomes, where platforms continue to operate under uncertain legal footing.

This keeps the filing question practical rather than procedural: a platform cannot rely on a broad template if the regulator insists that each contract version requires sufficient settlement and compliance detail for review.

Kraken Notice Keeps A Dormant Venue Available

The same Friday docket included a CFTC notice extending the regulatory status of Kraken Derivatives Exchange.

The platform has been under a dormant designation, with its last trade recorded in early 2025.

Kraken's request maintains the registered entity's position for renewed activity while the company evaluates its next steps after acquiring Bitnomial earlier this year.

For exchanges, this treatment separates permission to remain registered from proof that new contract listings, liquidity, or customer demand are ready.

The clearest unresolved point is legal authority: the advisory clarifies what the CFTC wants in self-certifications, but the court process still needs to determine how far federal oversight extends when states classify some event contracts as gambling.
